Xanado General Trading LLC (“Xanado” or “We” or “Us” or “Our” and their connotations) owns and manages the website and/or mobile application of Xanado (“Platform”). The visitors to the Platform and the registered users of the Platform hereinafter are referred to as “You” or “Your”. The term “Users” for the purposes of these terms and policy shall be read as You.

Xanado General Trading LLC and/or its Affiliates (collectively referred as "Xanado") provide website features and other products and services to You when You visit or shop at Xanado.market or use Xanado mobile application (the "Platform"), use Xanado products, or services provided through website, use Xanado applications for mobile, or use software provided by Xanado in connection with any of the foregoing (collectively "Xanado Services"). “Affiliate” means, with respect to a particular person, any entity that directly or indirectly controls, is controlled by, or is under common control with such person. Please see Our Privacy Policy to understand how We collect and process Your personal information through Xanado Services. Xanado provides the Xanado Services and sells Our products to You subject to the conditions set out on this page. Xanado.market is the trading name for Xanado.

Please read these conditions carefully before using Xanado Services. By using Xanado Services, You signify Your agreement to be bound by these conditions. We offer a wide range of Xanado Services, and sometimes additional terms may apply. When You use a Xanado Service (for example purchasing products from a third party listed on the Platform), You will also be subject to the terms, guidelines and conditions applicable to that of Xanado Service ("Service Terms").

As part of the Xanado Services, We will recommend features, products, and services that might be of interest to You, identify Your preferences, and personalize Your experience.

All content included in or made available through any Xanado Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations is the property of Xanado or its content suppliers and is protected by local and international copyright, authors' rights and database right laws. The compilation of all content included in or made available through any Xanado Service is the exclusive property of Xanado and is protected by local and international copyright and database right laws.
You may not extract and/or re-utilize parts of the content of any Xanado Service without Our express written consent. In particular, You may not utilize any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilization any substantial parts of the content of any Xanado Service, without our express written consent. You may also not create and/or publish Your own database that features substantial parts of any Xanado Service (e.g. Our prices and product listings) without Our express written consent.

This is a non-exhaustive list of Xanado trademarks. In addition to it, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Xanado Service are trademarks or trade dress of Xanado. Xanado's trademarks and trade dress may not be used in connection with any product or service that is not Xanado's, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits Xanado. All other trademarks not owned by Xanado that appear in any Xanado Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Xanado.

One or more patents apply to the Platform, certain features and services. This is a non-exhaustive list of applicable Xanado patents and applicable licensed patents.
Licence and access
Subject to Your compliance with these Conditions of Use and applicable Service Terms and Your payment of any applicable fees, Xanado or its content providers grant You a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Xanado Services. This license does not include any resale or commercial use of any Xanado Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Xanado Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
All rights not expressly granted to You in these Conditions of Use or any Service Terms are reserved and retained by Xanado or its licensors, suppliers, publishers, rights holders, or other content providers. No Xanado Service, nor any part of any Xanado Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without Our express written consent. You may not frame or use framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout, or form) of Xanado without Our express written consent. You may not use any meta tags or any other "hidden text" utilizing Xanado's names or trademarks without Our express written consent.
You may not misuse the Xanado Services. You may use the Xanado Services only as permitted by law. The licenses granted by Xanado terminate if You do not comply with these Conditions of Use or any Service Terms.
Your account
You may need Your own Xanado account to use certain Xanado Services, and You may be required to be logged into the account and have a valid payment method associated with it.
If there is a problem charging Your selected payment method, We may charge any other valid payment method associated with Your account.
If You use any Xanado Service, You are responsible for maintaining the confidentiality of Your account and password and for restricting access to Your account, and to the extent permitted by applicable law You agree to accept responsibility for all activities that occur under Your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform Us immediately if You have any reason to believe that Your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorized manner. You are responsible for ensuring that the details You provide us with are correct and complete, and for informing Us of any changes to the information You have provided. You can access Your information in the Your Account section of the Platform.
You must not use any Xanado Service: (i) in any way that causes, or is likely to cause, any Xanado Service, or any access to it to be interrupted, damaged or impaired in any way, or (ii) for fraudulent purposes, or in connection with a criminal offence or other unlawful activity, or (iii) to cause annoyance, inconvenience or anxiety.
We reserve the right to refuse service, terminate accounts or remove or edit content if You are in breach of applicable laws, these Conditions of Use or any other applicable terms and conditions, guidelines or policies.
Manner of use of platform
Display of Products for purchase on the Platforms is merely an invitation to offer. An order placed by You for purchase of a Product constitutes an offer. All orders placed by You on the Platforms are subject to the availability of such Product, Xanado’s acceptance of Your offer and Your continued adherence to these Terms. You acknowledge and undertake that You are accessing the Services provided on the Platform and are transacting at Your own risk and are using Your best judgment before entering into any transactions through the Platform. You may place the orders on the Platform for the products and at the price indicated therein.
You agree and acknowledge that You will have to make the requisite payment for the Services availed by them on the Platform. Xanado accepts online payments using either credit card, debit card, , digital wallets or other payment options as made available by the Platform from time to time. The payments made by You through the Platform for the purchase of the Products, is subject to the Fees and Payment Policy.
Upon payment of the consideration for the Products or undertaking to pay for the Product (in case of cash on delivery), the Product shall be delivered to You, in accordance with the delivery details mentioned in the product description.
All information in relation to third parties, including sellers and the Products as available on the Platforms (“Third Party Information”) are provided solely for reference. Xanado is not endorsing the Third Party Information and is not responsible for any errors and representation nor is it associated with it and You access the Third Party Information at the Your own risk.
Modifications to the service/products and prices
We reserve the right to change the Prices for Our service/product without notice at any point of time.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any point of time.
We shall not be liable to You or to any third-party for any modification, price change, suspension or discontinuance of the Service.
Products or services
We have made every effort to display as accurately as possible the description, information of Our services or product that appear at the Platform.
We reserve the right, but are not obligated, to limit the sales of Our Services or Product to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any services that We offer. Pricing are subject to change anytime without notice, at the sole discretion of us. We do not warrant that the quality of any products, services, content, videos, information, or other material purchased or obtained by You will meet Your expectations or provide the desired results, or that any errors in the Service will be corrected.
Removing your content
If We reasonably believe that any of Your content (1) breaches these terms or Our policies (2) violates applicable law, or (3) could harm Our users, third parties, then We reserve the right to take down some or all of that content in accordance with applicable law. Examples include child pornography, content that facilitates human trafficking or harassment, and content that infringes someone else’s intellectual property rights.
Accuracy of billing and account information
We reserve the right to refuse any order/subscription You place with Us. We may, in Our sole discretion, limit or cancel quantities/number of subscriptions purchased per user. These restrictions may include orders placed by or under the same user account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that We make a change to or cancel an order, We may attempt to notify You by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
You agree to provide current, complete and accurate purchase and account information for all purchases/Subscriptions made at Our Platform. If You post customer reviews, comments, customer questions or answers, or other content generated by You for display on the Platform (including any images, video or audio, all together "content", You grant Xanado a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, create derivative works from, distribute, make available, translate, and modify such content throughout the world in any media. You grant Xanado and Xanado’s sub-licensees the right to use the name that You submit in connection with such content.
You represent and warrant that You own or otherwise control all of the rights to the content that You post; that the content is accurate; and that use of the content You supply does not breach any applicable policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify Xanado for all claims brought by a third party against Xanado arising out of or in connection with the content and material You supply except to the extent that any liability arises from our failure to properly remove the content when it is notified of the illegal nature of the content arising out of or on the grounds of, or originating from the content that You have communicated to Us. Xanado has the right but not the obligation to monitor and edit or remove any activity or content. Xanado takes no responsibility and assumes no liability for any content posted by You or any third party.
Intellectual property claims
Xanado respects the intellectual property of others. If You believe that Your intellectual property rights have been used in a way that gives rise to concerns of infringement, please follow write to Us at …………….
Xanado software terms
In addition to these Conditions of Use, the terms found here apply to any software (including any updates or upgrades to the software and any related documentation) that We make available to You from time to time for Your use in connection with Xanado Services (the "Xanado Software").
Sanctions and export policy
UAE recognized two sanctions list: the UAE Terrorist List issued by UAE Federal Cabinet and the United Nations Consolidated List issued by the United Nation Security Council. You may not use any Xanado Service if You are the subject of these sanctions. Nothing in these Conditions of Use shall, or shall be interpreted or construed to, induce or require Xanado or You to act in any manner (including taking or failing to take any actions in connection with a transaction) which is inconsistent with or penalized under any applicable laws, regulations, rules, or requirements. Other business
Parties other than Xanado operate stores, provide services, or sell product lines on this Platform. In addition, We provide links to the sites of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, and We do not warrant the offerings of, any of these businesses or individuals or the content of their Platforms. Xanado does not assume any responsibility or liability for the actions, product, and content of all of these or any other third parties. When a third party is involved in Your transactions, We may share Your information related to those transactions with that third party. You should carefully review their privacy statements and other conditions of use.
Xanado's role
Xanado allows third party sellers to list and sell their products at Xanado.market. In each such case this is indicated on the respective product detail page. While Xanado helps facilitate transactions that are carried out on the Xanado marketplace, Xanado is neither the buyer nor the seller of the seller's items. Xanado merely provides a venue for sellers and buyers to negotiate and complete transactions. Accordingly, the contract formed at the completion of a sale for these third-party products is solely between buyer and seller. Xanado is not a party to this contract nor assumes any responsibility arising out of or in connection with it nor is it the seller's agent. The seller is responsible for the sale of the products and for dealing with any buyer claims or any other issue arising out of or in connection with the contract between the buyer and seller.
Xanado will, under no circumstances, be responsible for (a) product quality; (b) product condition; (c) originality of the product; (d) infringement of intellectual property rights associated with the product being sold; (e) any breach of claims made by the respective seller with respect to either of the above.

We are not responsible if information made available on this site is not accurate, incomplete or obsolete. Also, Your access to Xanado Services may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.
Further, Xanado does not make any representations or warranties that use of the Platform will be uninterrupted or error-free or virus free. You are responsible for taking all necessary precautions to ensure that any content You may obtain from the Platform is free of viruses or other harmful code.
Xanado will not be responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both You and Us when You commenced using the Xanado Services.
We will not be held responsible for any delay or failure to comply with Our obligations under these conditions if the delay or failure arises from any cause which is beyond Our reasonable control. This condition does not affect Your legal right to have goods sent or services provided within a reasonable time or to receive a refund if goods or services ordered cannot be supplied within a reasonable time owing to a cause beyond Our reasonable control.
You are held personally liable for any violation of a third party's rights by You. You agree to reimburse Xanado for all damages resulting from the culpable non-observance of the obligations of these Terms. Users release Xanado from all eligible claims that other users or third parties may file against the Xanado due to a violation of their rights by content posted by the user or due to a violation of other obligations. You shall assume the costs of Xanado legal defense, including all court and legal fees.
Xanado ensures that the information on the Platform is accurate but does not guarantee or warrant its accuracy, adequacy, fitness, correctness, validity, completeness, or suitability for any purpose, and accepts no responsibility with respect to the information on the Platform.
You agree and understand that Xanado does not states or claims any warranty for the quality of Session/Guidance/information/report delivered on Our Platform.
Xanado will not be held responsible for any unethical, illegal acts performed by the User based on the information/report/ advice obtained on Our Platform.

In no case shall Xanado, its Affiliates, directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from Your use of any of the service or any products procured using the service, or for any other claim related in any way to Your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
Xanado's total liability for any and all kinds claims in the aggregate, arising out of or related to Your use of the Platform, shall not under any circumstances exceed the total amounts/subscription actually paid by You to the Xanado for its Services/product.
To the maximum extent permitted by applicable law, Xanado disclaims all liability, whether based in contract, tort (including negligence), strict liability or otherwise, and further disclaims all losses, including without limitation indirect, incidental, consequential, or special losses and damages arising out of or in any way connected with access to or use of the Platform or the Content, even if Xanado has been advised of the possibility of such damages.
Limitation of liability, warranty and disclaimer
These conditions are governed by and construed in accordance with the laws of the Department of Economic Development (“DED”). If any dispute, claim, difference or controversy arising out of, relating to or having any connection with these conditions, including as it may relate in any way to Your use of any Xanado Service, or to any products or services sold or distributed by Xanado or through Xanado.market, or the existence, validity, interpretation, performance, breach or termination and/or any dispute relating to any non-contractual obligations arising out of or in connection with them (for the purpose of this section, a “Dispute”) the courts of the Dubai shall have exclusive jurisdiction to settle such Dispute and each party submits to the exclusive jurisdiction of the courts of the Dubai.
Alterations to service or amendments to the conditions of use
We reserve the right to make changes to any Xanado Services, policies, terms and conditions including these Conditions of Use, and Service Terms at any time. You will be subject to the terms and conditions, policies and Conditions of Use in force at the time that You use the Xanado Services. If any of these Conditions of Use is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
Waiver
If You breach these Conditions of Use and We take no action, We will still be entitled to use Our rights and remedies in any other situation where You breach these Conditions of Use.
Children
We do not sell products for purchase by children. We sell children's products for purchase by adults. If You are under 21 You may use the Xanado Services only with the involvement of a parent or guardian.

Users must comply with the laws that apply to You in the location that You access Xanado’s Services from. If any laws applicable to You restrict or prohibit You from using Xanado Services, You must comply with those legal restrictions or, if applicable, stop accessing and/or using the Xanado Services. You promise that all the information You provide to Xanado on accessing and/or using the Xanado Services is and shall remain true, accurate and complete at all times.

You must take no action to bypass authorized servers and/or use third party software to modify any aspect of the Xanado Service, whether for the purpose of securing an unfair advantage over other users, and You expressly consent to Xanado’s monitoring Your computer's random access memory for the purpose of identifying said unauthorized third-party programs.

You agree to indemnify, defend and hold harmless Xanado and Our parent, subsidiaries, Affiliates, proprietor, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of use of Our platform and/or Your breach of these Conditions of Use, Service Terms or the documents they incorporate by reference, or Your violation of any law or the rights of a third-party.
